This Privacy Policy covers “online” i.e. web and mobile services, including any websites operated by us such as Babyello. however accessed and/or used, whether via personal computers, mobile devices or otherwise collection of data through mailings, telephone, or in person activities owned, operated, provided, or made available by the Company.

BY ACCEPTING THE PLATFORM USER AGREEMENT, YOU AGREE TO THE TERMS OF THIS PRIVACY POLICY.

Please review the following carefully so that you understand our privacy practices. In case you do not agree to this Privacy Policy, do not accept the Platform User Agreement or use our App/Platform/Website. This Privacy Policy is incorporated by reference into the Platform User Agreement.

  1. Company may ask you to provide with certain information. When you create your account to use the App, you may create a user profile. Company shall ask you to provide only such information which is for lawful purpose connected with Company Services and necessary to be collected for such purpose.
  2. Based upon the information you provide when registering for an account, we will send you a welcoming email to verify your username and password.
  3. In case you upload an emergency contact (name and phone number) on your account / on the App, Company will be collecting and storing such contact information to use in an emergency situation.
  4. Company services are primarily provided through the App/Website. Company may collect and use technical data and related information, including but not limited to, technical information about your device, system and application software, and peripherals, that is gathered periodically to facilitate the provision of software updates, product support and other services to you (if any) related to such App.
  5. When you use our App/Website, it may automatically collect and store some or all of the information (“Mobile Device Information”) from your mobile/laptop device (“Device”) required to functioning of the App/Website in addition to the Device information, including without limitation.
  6. Data from SMS/ text messages upon receiving Device permissions for the purposes of (i) issuing and receiving one -time passwords and other Device verification, and (ii) automatically filling verification details, either through us or a third-party service provider, in accordance with applicable law. We do not share or transfer SMS/ text message data to any third party other than as provided under this Privacy Policy.
  1. You consent to the Company holding and processing, both electronically and manually, the data it collects in relation to You, for the purpose of the Company’s administration and management, its business and for compliance with applicable procedures, laws and regulations.
  2. You also consent to the transfer, storage and processing by the Company of such data outside India, where the Company may have its offices. You also consent that the Company shall use your registered mobile number and e-mail ID for all or any communication w.r.t. the App/Website and the Agreement which includes Company’s Services like SMSs intimations/WhatsApp intimations including making You part of the requisite chat groups, as required; and you hereby provide unconditional acceptance to the same.
  3. You further understand, covenant and consent that the App/Website has certain features or functionality that it will collect or be dependent on data related to your geographic location (“Location Data”). If you wish to use the App and its services, you agree to provide or to make your Location Data accessible to the App/Company. To the extent that the App/Company collects Location Data, the same will be used in accordance with the Privacy Policy of the Company as available in the App/Website. If you do not provide or make such Location Data accessible, then the functionality of the App or the Company’s Services may be limited or not operate. The Location Data will include the real-time geographic location of your device or computer that you attempt to locate using the App/Website and you hereby agree and consent to the Company’s/associates’ and licensor’s collection, use, transmission, processing and maintenance of such Location Data to provide Company’s Services. In addition, by enabling and or using any location-based services or features provided through the App, you agree and consent to the Company/associates and licensees collecting, using, processing and maintaining information related to your account, and any devices or computers registered thereunder, for the purposes of providing such location-based services or feature to you. Such information may include, but is not limited to, your account ID and name and information thereof, device and/or computer ID and name, device and/or computer type and geographic location of your device and/or computer. You can withdraw your consent at any time by terminating the Agreement/deleting the App.
  4. Company stores and processes your information, including any sensitive financial information, in accordance with the Information Technology Act, 2000 and the Rules made there under as well as Company’s policy. If you object to your information being used in the manner prescribed by law or under Company’s Policy, you should terminate this Agreement with immediate effect while deleting your Account forthwith.
  5. During your association hereunder, you may be exposed to or shared with the Confidential Information of the Company and in reference to the same, the Company considers and you agree that the restraints set forth in the Agreement against non-disclosure of confidential information are necessary for the reasonable protection of interest of the Company of its business or the business of the group companies, the clients thereof or affairs thereto. You shall not at any time, either during the continuance of or after the termination of your association with the Company, use, disclose or communicate to any person whatsoever any confidential information which you have or of which you may have become possessed during your association with the Company nor shall you supply the names or addresses of any clients, customers, vendors or agents of the Company to any person except as authorised by the Company or as ordered by a Court of competent jurisdiction. You agree that you will not at any time during the continuance of your association or on expiry or on termination/cessation of your association with the Company or thereafter, issue any statements to the press or third person (whether oral or written) which have not expressly been authorised by the Company or which may be detrimental to the interest of the Company. The obligations under this Clause shall survive the termination or expiration of the Agreement.
  6. We use the information collected from our App so that we are able to serve you the correct App/Website version depending on your Device type, for troubleshooting and in some cases.
  7. We use your Internet Protocol (IP) address to help diagnose problems with our computer server, and to administer our web site(s). Your IP address is used to help identify you, but contains no personal information about you.
  8. If our services are temporarily suspended for maintenance, we might send you an email. If you do not wish to receive them, you have the option to deactivate your Account.
  9. We may use the information obtained from you to prevent, discover and investigate violations of this Privacy Policy or any applicable terms of service or terms of use for the App/Website.
  10. We do not sell, share, rent or trade the information we have collected about you, other than as disclosed within this Privacy Policy or at the time you provide your information.
  11. You shall be presented with the information against the requests made by you, as the case may be. If you agree to have your information shared, your information will be disclosed to such third parties and all information you disclose will be subject to the privacy policy and practices of such third parties. We are not responsible for the privacy policies and practices of such third parties and, therefore, you should review the privacy policies and practices of such third parties prior to agreeing to receive such information from them. If you later decide that you no longer want to receive communication from a third party, you will need to contact that third party directly.
  12. We cooperate with Government and law enforcement officials and private parties to enforce and comply with the law. Thus, we may access, use, preserve, transfer and disclose your information (including Information, IP address, Device Information or geo-location data), to Government or law enforcement officials or private parties as we reasonably determine is necessary and appropriate: (i) to satisfy any applicable law, regulation, subpoenas, Governmental requests or legal process; (ii) to protect and/or defend the terms and conditions for online and mobile services or other policies/Company’s Services applicable to any online and mobile services, including investigation of potential violations thereof; (iii) to protect the safety, rights, property or security of the Company, Company’s Services or any third party; (iv) to protect the safety of the public for any reason; (v) to detect, prevent or otherwise address fraud, security or technical issues; and /or (vi) to prevent or stop activity we may consider to be, or to pose a risk of being, an illegal, unethical, or legally actionable activity.
  13. We may share your information, including your protected information and usage information with our parent, subsidiaries and affiliates for internal reasons, including business and operational purposes. We also reserve the right to disclose and transfer all such information: (i) to a subsequent owner, co-owner or operator of the Services or applicable database; or (ii) in connection with a corporate merger, consolidation, restructuring, the sale of substantially all of our membership interests and/or assets or other corporate change, including, during the course of any due diligence process.
  14. You are responsible for maintaining the accuracy of the information you submit to us, such as your contact information provided as part of account registration. If your Information changes, or if you no longer desire to use App services, you may correct, delete inaccuracies, or amend information by making the change on our member information page or by contacting us through email address mentioned on our website or App. We will make good faith efforts to make requested changes in our then active databases as soon as reasonably practicable subject to necessary documentation, if required.
  15. You may also cancel or modify your communications that you have elected to receive from the Company’s Services by following the instructions contained within an e-mail or by logging into your user account and changing your communication preferences.
  16. The information and usage information we collect is securely stored within our databases, and we use standard, industry-wide, commercially reasonable security practices such as encryption, firewalls and SSL (Secure Socket Layers) for protecting your information. However, as effective as encryption technology is, no security system is impenetrable. We cannot guarantee the security of our databases, nor can we guarantee that information you supply won’t be intercepted while being transmitted to us over the Internet or wireless communication, and any information you transmit to the Company you do at your own risk. We recommend that you not disclose your password to anyone.
  17. From time to time, we may update this Privacy Policy to reflect changes to our information practices. Any changes will be effective immediately upon the posting of the revised Privacy Policy. If we make any material changes, we will notify you by email (sent to the e-mail address specified in your account) or by means of a notice on the Services prior to the change becoming effective.   1. Disclosure and Transfer of User’s Personal Information:

We may need to disclose/transfer User’s Personal Information to certain third-party service providers in order to provide Users with the Services they have opted for.

We may need to disclose / transfer User’s Personal Information to Governmental and judicial institutions/authorities, to the extent required:

a) Under the laws, rules, and regulations and/or under orders of any relevant judicial or quasi-judicial authority;

b) To protect and defend the rights or property of the Company;

c) To fight fraud and credit risk;

d) To enforce the Company's Terms of Use (to which this Privacy Policy is also a part); or

e) When the Company, in its sole discretion, deems it necessary in order to protect its rights or the rights of others.

The Company may also make all User Information accessible to its employees and data processors/third party vendors only on a need-to-know basis and for the purposes set out in this Privacy Policy. The Company takes adequate steps to ensure that all the employees and data processors/third party vendors, who have access to, and are associated with the processing of User Information, respect its confidentiality and that such data processors/third party vendors adopt at least such reasonable level of security practices and procedures as required under applicable law. However, the Company does not disclose information, individually labeled or aggregated, obtained through Marketplace Application programming interface on behalf of a User to other Users or any third parties, unless required by law. Non-personally identifiable information may be disclosed to third party ad servers, ad agencies, technology vendors and research firms to serve non-targeted advertisements to the Users. The

Company may also share its aggregate findings (not specific information) in a non- personally identifiable form based on information relating to the User’s internet use (to the extent set out in this Privacy Policy) to prospective, investors, strategic partners, sponsors and others in order to help growth of Company's business.

 

We may also disclose or transfer the User Information, to another third party as part of reorganization or a sale of the assets or business of Company. Any third party to which the Company transfers or sells its assets will have the right to continue to use the Personal Information and/or other information that a User provides to Us in a manner consistent with this Privacy Policy.

The relevant information/data may be required to be shared by the Company with its affiliates, subsidiaries and group companies in order to facilitate the provision of Services by the Company and/or its affiliates, subsidiaries and group companies to us and/or to You. To the extent that these entities have access to Your Personal Information which is shared by the Company, the Company shall take adequate steps to ensure that these entities shall adopt at least such reasonable level of security practices and procedures as required under applicable law to ensure security of Personal Information.

The links to third-party advertisements, third party websites or any third-party electronic communication services (referred to as “Third Party Links”) may be provided on the platform which are operated by third parties and are not controlled by, or affiliated to, or associated with the Company, unless expressly specified on the Platform.

 

If You access any such Third-Party Links, we request You to review the concerned website’s privacy policy. We shall not be responsible for the policies or practices of such third parties.

 

Security Practices and Procedures:

For the purpose of providing the Services and for other purposes identified in this Privacy Policy, we are required to collect and host certain data and information of the Users. We are committed to protecting Your Personal Information, and to that end, the Company adopts reasonable security practices and procedures to implement technical, operational, managerial

and physical security control measures in order to protect the Personal Information in its possession from loss, misuse and unauthorized access, disclosure, alteration and destruction. While we try our best to provide security that is commensurate with the industry standards, due to the inherent vulnerabilities of the internet, we cannot ensure or warrant complete security of all information that is being transmitted to Us. The Company takes adequate steps to ensure that third parties to whom the Personal Information may be transferred adopt at least such reasonable level of security practices and procedures as required under applicable law to ensure security of Personal Information. You hereby acknowledge that the Company is not responsible for any information sent via the internet that has been intercepted beyond Our control after having adopted reasonable security practices and procedures, and You hereby release Us from any and all claims arising out of or related to the use of intercepted information in any unauthorized manner.

 

User's rights in relation to their personal information collected by the Company:

All the information provided to the Company by a User, including Sensitive Personal Data or Information, is voluntary. User has the right to withdraw his/her/its consent at any time, in accordance with the terms of this Privacy Policy and the Terms of Use, but please note that withdrawal of consent will not be retrospective.

Users can access, modify, correct and delete the Personal Information provided by them which has been voluntarily given by the User and collected by the Company in accordance with this Policy and Terms of Use. However, if the User updates his/her information, the Company may keep a copy of the information which User originally provided to the company in its archives for User documented herein. In case the User seeks to update or correct, his/her Personal Information, the User may exercise these rights by emailing the Company at ___________________ and communicate the change(s) for updating the

Company’s records.

In case the User does not provide his/her information or consent for usage of Personal Information or subsequently withdraws his/her consent for usage of the Personal Information so collected, the Company reserves the right to discontinue, in part or full, the Services/associated features and benefits for which the said information was sought.

 

 

 

For how long do the Company keep Personal Information:

Any personal information collected or processed in accordance with this Privacy Policy will be collected by Us, and retained on our behalf either by Us or with Web Services. located Company will retain your Personal Information for as long as needed to fulfil the purpose for which it was collected and for any longer period thereafter in order to comply with applicable law. In case a User has withdrawn or cancelled their registration from the Platform, we are obliged under law to retain their Personal Information for a period of one hundred and eighty days after such cancellation. We may retain non-personally identifiable data indefinitely or to the extent allowed by applicable law.

 

Use of the Platform:

You agree while using Platform, You shall not upload, modify, publish, transmit update or share any information which:

a) belongs to another person and to which the user does not have any right;

b) is obscene, pornographic, paedophilic, invasive of another’s privacy including bodily privacy, insulting or harassing on the basis of gender, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or promoting enmity between different groups on the grounds of religion or caste with the intent to incite violence;

c) is harmful to child; infringes any patent, trademark, copyright or other proprietary rights;

e) deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any misinformation or information which is patently false and untrue or misleading in nature;

f) impersonates another person;

g) threatens the unity, integrity, defence, security or sovereignty of India, friendly relations

with foreign States, or public order, or causes incitement to the commission of any cognizable offence, or prevents investigation of any offence, or is insulting other nation;

h) contains software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource;

i) violates any law for the time being in force.

 

 

Termination

AKAAY LIVING reserves the right to immediately terminate your use of Services in cases where:

(a) the User breaches any terms and conditions of this Policy;

(b) AKAAY LIVING believes in its sole discretion that the User’s actions may cause legal liability for such User or for AKAAY LIVING or are contrary to the terms of use of the Services, or terms of this Policy; and

AKAAY LIVING deems fit for its own convenience, without providing any reason.

 

Changes to this Privacy Policy:

We may update this Privacy Policy from time to time and shall notify you regarding the Policy as well as any such changes periodically and at least once a year. However, you are advised to review this page/policy periodically for any changes. Your continued usage of the Services shall constitute your acceptance of the amended/updated Privacy Policy.
